Agreement Terms

This Agreement is established between 3Jinn Inc. (“the Company”) and the purchaser of the digital product (“Client”) for the purpose of the Client purchasing a digital product from the Company’s online platform (“the Product”). By checking the box on the “sign up” page or by submitting payment for the Product, the Client agrees to adhere to the terms and conditions set forth below.

1. DIGITAL PRODUCT USAGE

Upon the purchase of a digital product from 3Jinn.com, clients are granted immediate access to the product’s dashboard. This access encompasses various features, including an investor database, startup document templates, and other resources, which remain available as long as the client’s subscription is active.

3Jinn.com grants clients a single, exclusive, non-transferable, and non-sublicensable license to use the product. Clients are authorized to use the product for both personal and business purposes and may alter the language of the product content as needed. However, clients are not required to credit 3Jinn.com when using, posting, or sharing content derived from the product.

It is important to note that the product materials are not to be shared with any third party. If 3Jinn.com suspects that the product is being shared unauthorizedly, we reserve the right to immediately terminate the client’s access to the product. This license is designed to ensure that each client enjoys the full benefit of the product while respecting the intellectual property rights of 3Jinn.com.

2. FEES AND PAYMENT PROCESSING
For access to the digital products provided by 3Jinn.com, clients agree to pay the fees as specified on the 3Jinn.com pricing page. All fees are due as per the terms mentioned on the pricing page and are subject to the following conditions:

Payment Processing: Payments will be processed through an established online payment system. Clients are responsible for providing valid and current payment methods. If a payment method is declined, access to the digital product may be suspended until a valid payment method is provided.
Outstanding Payments: In cases where a client has been granted access to the product but a subsequent payment is declined, 3Jinn.com reserves the right to take necessary actions to collect any outstanding amounts. This may include suspending access to the product and other legal actions.
Subscription Continuity: For subscription-based products, it is the client’s responsibility to ensure uninterrupted service by maintaining up-to-date payment information. Failure to do so may result in the suspension of access to the product.

3. REFUND POLICY

Time Frame for Refunds: Clients are eligible for a full refund within 24 hours of their purchase if they are not satisfied with the product. This allows clients to evaluate the product’s suitability for their needs.

Clients agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. They further agree to promptly update account and other information, including email address and credit card numbers and expiration dates, so that we can complete transactions and contact them as needed.

5. COPYRIGHT
Upon the successful purchase and delivery of a digital product from 3Jinn.com, the following copyright terms apply:

Ownership and Rights: All digital products provided by 3Jinn.com are the intellectual property of 3Jinn Inc. or its content creators. The purchase of a digital product grants the client a license to use the product under the terms set forth in this Agreement, but does not confer ownership of the original copyright material.
License to Use: Clients are granted a limited, non-exclusive, non-transferable license to use the digital product for personal or business purposes as per the guidelines of this Agreement. This license does not allow for the resale, redistribution, or modification for resale of the product.
Restrictions: Clients may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any digital product from 3Jinn.com, unless expressly permitted by the Company in writing.
Protection of Intellectual Property: Any unauthorized use of the digital products may constitute a violation of applicable copyright laws and could subject the client to legal action.
Credit and Attribution: While clients are not obligated to credit 3Jinn.com when using the product, appropriate attribution is appreciated where feasible.

Clients acknowledge that any unauthorized use or distribution of the digital products may result in termination of the license granted under this Agreement and may expose them to legal liability.

6. WARRANTIES AND LIABILITY

Warranties: 3Jinn.com endeavors to ensure that all digital products are as described and fit for their intended purpose. However, except as expressly stated in this Agreement, 3Jinn.com makes no specific warranties or representations regarding the digital products. All warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose, are hereby disclaimed to the fullest extent permissible by law.

Limitation of Liability: To the maximum extent permitted by applicable law, 3Jinn.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the digital products; (ii) any conduct or content of any third party related to the digital products; (iii) any unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not 3Jinn.com has been informed of the possibility of such damage.
Client Responsibility: The client acknowledges that they are using the digital product at their own risk. The client agrees to indemnify and hold harmless 3Jinn.com, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement or any activity related to the client’s account (including negligent or wrongful conduct) by the client or any other person accessing the service using the client’s account.
Use of Product: 3Jinn.com is not liable for any decisions made or actions taken based on the information or resources provided through the digital product. Clients are responsible for their own business and personal decisions.

This section outlines the scope of warranties and limitations of liability regarding the use of digital products from 3Jinn.com. Clients should be aware of these terms and acknowledge their understanding and agreement.

7. FORCE MAJEURE

3Jinn.com shall not be deemed in breach of this Agreement if we are unable to complete the Services or any portion thereof due to the occurrence of events beyond our control. These events may include, but are not limited to:

Natural disasters (such as earthquakes, floods, storms)
Acts of war, terrorism, riots, or civil disorder
Fire, epidemics, pandemics
Labor strikes or disputes
Governmental regulations or advisories
Electrical, technological, or network failures or disruptions
Other unforeseen circumstances that may hinder or prevent the access to and delivery of the digital products

Under such conditions, 3Jinn.com is excused from performing its obligations and will resume the Services once the situation has been rectified or returned to normal. If such conditions persist for an extended period, 3Jinn.com will communicate with the client regarding the status of the services and potential solutions.

Clients acknowledge that in the event of a force majeure, any delays or failures in performance are not grounds for termination of the Services or refund of any payments made.

8. GUARANTEES
3Jinn.com strives to provide high-quality digital products and services. However, we:

Do Not Guarantee Specific Results: While we endeavor to ensure our products are beneficial, we cannot guarantee specific outcomes, results, or successes as a result of using our digital products. The effectiveness of our products may vary based on individual use, circumstances, and effort.
Performance and Use: Clients understand that the ultimate performance of the digital product is subject to their application and use. 3Jinn.com is not responsible for the individual success or failure that clients may experience after purchasing and using the product.
No Guarantee of Uninterrupted Service: We aim to ensure continuous and uninterrupted access to our digital products. However, the availability of our services may be influenced by factors outside our control, and we cannot guarantee uninterrupted service at all times.

Clients acknowledge and agree that they are using 3Jinn.com’s digital products at their own discretion and risk and that the company does not provide any warranties or guarantees beyond those explicitly stated in this Agreement.

9. RELEASE AND REASONABLE EXPECTATIONS

Understanding of Services: Clients acknowledge that they have a reasonable understanding of the services and digital products offered by 3Jinn.com. Clients have reviewed the descriptions and specifications of the digital products and have a clear expectation of their functionality and applicability.
Release of Liability: By agreeing to this section, clients release 3Jinn.com from any claims, damages, or liabilities that might arise from the use of the digital products. This includes any misunderstandings or misinterpretations regarding the potential outcomes or results of using the products.
Diverse Outcomes: Clients understand and agree that the results of using 3Jinn.com’s digital products can vary significantly based on factors such as individual effort, circumstances, and application of the product. As such, there is no guarantee that all clients will experience the same outcomes.
Reasonable Expectations: Clients agree that they have formed reasonable expectations about the digital products based on the information provided by 3Jinn.com. Clients acknowledge that the effectiveness and success of the products depend on various factors, including their proper usage and application in line with 3Jinn.com’s guidelines.

By purchasing and using the digital products from 3Jinn.com, clients confirm that they have reasonable expectations regarding the nature and potential of the products and release 3Jinn.com from any claims arising from these expectations.

10. ENTIRE AGREEMENT

This document, along with any other materials referenced within it that are provided by 3Jinn.com (such as FAQs, guidelines, or instructions), constitutes the entire agreement between 3Jinn Inc. and the client regarding the purchase and use of digital products. This agreement supersedes all prior understandings, agreements, representations, or warranties, both written and oral, regarding its subject matter.

No Modifications Unless in Writing: Any modifications or amendments to this agreement, including any additional or altered terms, will only be valid if they are in writing and signed by both parties. Furthermore, such amendments must be attached to this original agreement.
Precedence: In the event of any conflict between this Agreement and any other document or information provided by 3Jinn.com, the terms of this Agreement shall prevail.
Acknowledgment of Agreement: By purchasing a digital product from 3Jinn.com, the client acknowledges that they have read, understood, and agree to be bound by the terms and conditions contained within this agreement.

11. TRANSFER

This Agreement between the client and 3Jinn Inc. is personal to the client and cannot be transferred or assigned to any other person or entity without the express written consent of 3Jinn Inc.

Non-Transferable License: The license granted to the client for the use of 3Jinn.com’s digital products is exclusive to the client and cannot be sold, transferred, sublicensed, or otherwise assigned to another party.
Restrictions on Account Transfer: Clients are prohibited from transferring or selling their accounts or access to 3Jinn.com’s digital products to another individual or entity. Any attempt to do so will be considered a violation of this Agreement and may result in the termination of the client’s account and access to the products.
Company’s Right to Transfer: 3Jinn Inc. reserves the right to transfer or assign its rights and obligations under this Agreement to another entity in the case of a merger, acquisition, sale of assets, or by operation of law, without prior notice to or consent from the client.

Clients agree to these transfer conditions upon purchasing a digital product from 3Jinn.com and acknowledge that their rights under this Agreement are non-transferable.
